The arbitration shall take place in Summit County, Ohio, or remotely if agreed upon by the parties. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing, Premier 1 Pool & Patio may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

11.4 Class Action Waiver

YOU AND PREMIER 1 POOL & PATIO EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a Dispute proceeds in court rather than in arbitration, you and Premier 1 Pool & Patio each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action. If this class action waiver is found to be unenforceable, then the arbitration provision of these Terms shall be null and void.
